Terms and Conditions

These Terms and Conditions ("Agreement") govern the provision of interior design services ("Services") by Dezyn iQ ("Company") to the client ("Client"). By engaging the Company for Services, the Client agrees to comply with and be bound by this Agreement.

The Company agrees to provide Dezyn iQr design services as detailed in the project proposal or scope of work provided to the Client. This may include, but is not limited to, design consultations, space planning, color consultations, material and furniture selection, and project management.

The Company will provide an estimated timeline for the completion of the Services. The Company will make every effort to adhere to this timeline; however, the Client acknowledges that delays may occur due to unforeseen circumstances.

Fees and Payment

  • Fee Structure: Fees for Services will be outlined in the proposal or contract provided to the Client.
  • Payment Schedule: Payments will be made according to the payment schedule agreed upon in the proposal or contract.
  • Additional Costs: Any additional costs, including but not limited to materials, furniture, and contractor fees, will be billed separately and must be paid by the Client.
  • Late Payments: Late payments will incur a fee of 5% per month on the outstanding balance.

Changes to Scope of Work

Any changes to the scope of work must be requested in writing and approved by the Company. Additional fees may apply for changes requested by the Client.

Client Responsibilities

The Client agrees to:

  • Provide accurate and complete information regarding the project requirements.
  • Make timely decisions to avoid delays.
  • Provide access to the property as necessary for the completion of the Services.
  • Ensure all third-party contractors adhere to the agreed schedule.

Intellectual Property

All designs, drawings, and materials produced by the Company remain the intellectual property of the Company. The Client is granted a limited license to use these materials solely for the purpose of the project.

Confidentiality

Both parties agree to keep confidential all information regarding the project and each other's business operations, unless required by law or with the written consent of the other party.

Termination

Either party may terminate this Agreement with 30 days' written notice. The Client will be responsible for payment of all Services rendered and costs incurred up to the date of termination.

Warranties and Liability

Warranties: The Company warrants that it will perform the Services with reasonable skill and care.

Liability: The Company's liability for any claims arising out of this Agreement is limited to the amount of fees paid by the Client for the Services. The Company is not liable for any indirect, incidental, or consequential damages.

Dispute Resolution

Any disputes arising under this Agreement will be resolved through mediation. If mediation fails, the dispute will be resolved through binding arbitration in accordance with the rules.

This Agreement is governed by the laws of Telnagana, India. Any legal actions must be brought in the courts located in Telnagana, India.

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral, relating to its subject matter.

This Agreement may be amended only by a written document signed by both parties.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

The failure of either party to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.

By engaging the Company for Services, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
